Draft: pending legal review

This page is a working draft. It has not been reviewed by a lawyer and must not be relied on until it has. It is available in English only.

Terms of service

This draft sets out the terms on which Nucleic TV is licensed. Text in [square brackets] is a decision or a fact that still has to be filled in before launch.

The service

Nucleic TV is a media player for smart TVs, plus an account site where you manage your licence, your TVs and your saved playlist links. Subject to these terms you receive a personal, non-transferable licence to use the player on up to three TVs at a time.

Player only, no content

Nucleic TV does not provide, host, sell or recommend channels, streams or playlists. You supply your own sources, and you alone are responsible for having the right to access and watch them in your country.

We may suspend an account that is used to access content without authorisation, or after a valid notice of infringement. [Counsel to confirm the notice-and-action wording.]

Your account

  • Give accurate details and keep your password safe; you are responsible for activity under your account.
  • One licence belongs to one account. Seats (TVs) can be released from your account and re-used.
  • Do not share your account or licence beyond the TVs the licence allows.

Licences and payment

Two licence types are offered: a yearly subscription, which renews each year until cancelled, and a lifetime licence, which is a single payment. The price you pay is the one shown at checkout.

Purchases are made through Polar Software, Inc. (Polar.sh), which acts as Merchant of Record: it sells the licence to you, takes payment, and handles tax and receipts under its own terms.

"Lifetime" means [definition to be settled by counsel, for example: for as long as we offer the Nucleic TV service for your TV platform].

Cancelling and access

You can cancel a yearly subscription at any time in the customer portal linked from your account. Access continues until the end of the period you paid for.

If a renewal payment fails, access continues while the payment provider retries. A licence can be revoked for abuse or a successful chargeback. [Confirm the exact rules.]

Early access

The TV app is still being developed and tested. Features may change, and anything marked "coming soon" is a plan, not a promise or a date.

Acceptable use

  • No attempt to disrupt, overload or probe the service or its API.
  • No reverse engineering except where the law allows it regardless of this clause.
  • No use of the service to break the law or the rights of others.

Warranty and liability

[Disclaimer and limitation of liability: to be drafted by counsel. Statutory consumer rights are not excluded.]

Governing law and contact

[Governing law and venue: to be completed.] Questions about these terms: [contact email: to be completed].
